Copyright Infringement and the Digital Millennium Copyright Act

We take copyright infringement seriously. As an Internet Service Provider, we intend to comply with all provisions of the Digital Millennium Copyright Act, and it is our policy to respond to proper notice (complying with the Digital Millennium Copyright Act) of copyright infringement claims. We will promptly terminate accounts and account holders when we have determined, in our sole discretion, those to be “repeat infringers.”

If you submit a notice of copyright infringement to us, you should be aware that pursuant to 17 U.S.C. § 512(f) you may be subject to liability if you knowingly materially misrepresent that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification. We reserve the right to share a copy of any notification or counter-notification with third parties, at our sole discretion.

Quite simply: don’t use someone else’s intellectual property, and don’t claim rights to works or content for which you have no such rights.

Infringement Notification

If you are a copyright owner or an agent of a copyright owner, and you believe that content displayed or hosted on the Starbloom platform infringes your copyrights, you may submit a written notification of claimed infringement to Starbloom’s designated copyright agent, listed below.

To best ensure that your notice of infringement is timely acted upon, make sure that the notice complies with the requirements of the Digital Millennium Copyright Act. See 17 U.S.C. § 512 for those requirements. If these requirements are not met, we may not act on the notification.

A direct link to the video, stream, clip, comment, or profile is the single most useful thing you can give us. We cannot act on a description alone.

Counter-Notification

If you are an account holder and a notification of infringement has been submitted against content you have uploaded, posted, or displayed, you are well advised to review the details provided, seek legal counsel, and consider your options.

If you believe that the notification was sent in error, you can submit a counter-notification by emailing legal@starbloomstreaming.com. To be effective, the counter-notification must comply with the Digital Millennium Copyright Act. See 17 U.S.C. § 512 for those requirements. If these requirements are not met, we may not act on your counter-notification.

Infringement Claim Retractions

Starbloom honors retractions of claims and notifications of copyright infringement from the party that originally submitted them, to the extent reasonably possible. If you or your account is subject to such a notice, you may reach out to the party that filed the notification directly to seek a retraction. This does not, however, guarantee that Starbloom will reinstate any particular content.

To retract your copyright infringement notification, email legal@starbloomstreaming.com from the same email address as on your original notification. You must include:

  • A clear identification of the material you wish to retract, including the specific URL.
  • The date of the original notification.
  • An electronic or physical signature which matches the original notification.

Repeat Infringer Policy

A user or account holder will be deemed a repeat infringer upon a third valid takedown notice representing a third separate and distinct copyright violation for content posted or displayed by that user or account holder. Upon meeting the definition of a repeat infringer, the account will be terminated. Termination ends the account and the account holder’s access to the Starbloom platform.

We reserve the right to redefine “repeat infringer” at our sole discretion. We also reserve the right to terminate an account upon a claimed infringement where the account holder does not meet the definition of repeat infringer, at our sole discretion, where we believe the circumstances warrant.

A notice that is withdrawn by the complainant, or reversed by a valid counter-notification, does not count toward this.
